WHO SHOULD APPLY IN FRANKLIN TOWNSHIP:

Applicants (at least one) who reside in Franklin Township. If neither applicant is a NJ resident, submit the application in the municipality where the ceremony is taking place.

The Franklin Township Clerk’s Office, 475 DeMott Lane, Somerset

ALL APPLICATIONS ARE DONE BY APPOINTMENT ONLY:

Office hours Monday thru Friday from 8:30am – 4:30pm. The last appointment is 3pm.

PERSONS REQUIRED TO BE PRESENT AT TIME OF APPLICATION:

Both applicants & 1 witness, who is 18 years of age or older

ITEMS REQUIRED AT TIME OF APPLICATION – ALL DOCUMENTS MUST BE IN ENGLISH:

1. Driver’s license, passport or state/federal I.D.
2. Proof of residency only if a NJ resident
3. Social Security number
4. $28.00 fee. Cash or check only.

Please make sure applicant has a valid id with current address on it. If presenting a passport and utility bill, make sure the names match, including middle names. 

WHEN TO COME IN AND WAITING PERIOD, AFTER FILLING OUT THE APPLICATION:

The recommendation is to come in at least two weeks before the ceremony. There is a mandated 72-hour waiting period from the time of application. (Remember, we are closed on weekends, which means you must apply by Tuesday in order to pick up the license on Friday for Friday night, Saturday or Sunday ceremony). The license is good for 30 days from the date of pick up. 

REMARRIAGE LICENSE:

Bring a certified copy of your existing marriage certificate. No waiting period required. Please call if you have any questions. 

MINORS – (UNDER 18 YEARS OLD):

Contact the Clerk’s Office for specific information.

REQUIREMENTS FOR ENTERING INTO A CIVIL UNION:

• Not be a party of another civil union, domestic partnership or marriage in state or that is recognized by this state
• Be of the same sex
• Be at least 18 years of age

Same sex couples currently registered in a domestic partnership in New Jersey may enter into a civil union with the same partner and such entry into a civil union will terminate the previous domestic partnership.

PROCEDURE TO REGISTER A DOMESTIC PARTNERSHIP

REQUIREMENTS FOR REGISTER A DOMESTIC PARTNERSHIP:

Couples wishing to register a Domestic Partnership must be of same sex couples OR opposite sex couples who both are 62 years of age or older. Couples must meet the following requirements:

1. Share a common residence in NJ or in any other jurisdiction provided that at least one of the applicants is a member of a NJ State-administered retirement system.
2. Both persons are jointly responsible for each other’s common welfare as evidenced by joint financialarrangements of join ownership of real or personal property.
3. Both persons agree to be jointly responsible for each other’s basic living expenses during the domesticpartnership.
4. Not be party to a marriage or civil union recognized by NJ law or a member of another domestic partnership
5. Not be related up to each other by blood or affinity up to and including the fourth degree of consanguinity.
6. Chose to share each other’s lives in a committed relationship of mutual caring.
7. Not have legally terminated another domestic partnership within the last 180 days. (This prohibition does not apply when the previous partnership ended due to the death of the other partner).

WHERE SHOULD THE AFFIDAVIT OF DOMESTIC PARTNERSHIP BE FILED:

The Affidavit of Domestic Partnership must be filed and registered with the Registrar of Vital Statistics in any municipality in the State of New Jersey.

ITEMS REQUIRED WHEN FILING THE AFFIDAVIT OF DOMESTIC PARTNERSHIP WITH A REGISTRAR:

1. Identification that establishes name, age, date of birth and proof of residency. This may be supplied by one or more documents issued by a government agency, such as certified copy of a birth certificate, driver’s license, military identification, or state/county identification card. A registration or operator’s license that is registered with the Motor Vehicle Commission will be accepted.
2. If the residence is outside NJ, at least one of the applicants must provide proof of membership in a NJ State Retirement System by providing one of the following documents issued by the Division of Pension and Benefits:

a. Personal Benefits Statement from the current or previous year
b. 1099R from the current of previous year, or
c. Certificate of Pension Membership

3. Applicants must provide proof of joint financial responsibility, evidenced by at least one of the following documents:

a. Joint deed, mortgage agreement or lease.
b. Joint bank account’
c. Designation of one of the persons as primary beneficiary in the other person’s will.
d. Designation of one of the persons as primary beneficiary in the other person’s insurance policy or retirement plan; or:
e. Joint ownership of a motor vehicle
